Privacy Policy

This Privacy Policy applies to any visitor or user (hereinafter referred to as “You”) of the website located at www.agi.com (“Site”) or a User of the Systems Tool Kit (STK) software suite (“Software”). Analytical Graphics, Inc. (AGI) is sensitive to the issue of confidentiality in online dealings and is committed to protecting individual privacy. This Privacy Policy is intended to inform users about the general approach AGI uses in collecting, using and disseminating user information via the Site or the Software. Our information collection policy is described below.

1. What Personally Identifiable Information May Be Collected?

1.1 To respond to your requests or to enable you to register or to use certain features of this Site or the Software, we may request personally identifiable information from you including, but not limited to, your name, mailing address, email address and/or telephone number. The information AGI collects is used to comply with US Government export regulations, complete transactions; ensure appropriate legal use of licensed AGI software; provide notification to licensees about updates to AGI’s software, data and services; help provide technical and product support to our users; and to send you marketing materials, unless you notify us that you do not want to receive these materials. AGI may pass this data to an AGI international reseller that provides the above services in your country or to an AGI vendor whose software, data and services are used to meet your needs or process transactions. We do not collect any more personally identifiable information than is reasonably necessary to enable your participation in the activities we offer or to comply with US Government requirements.

1.2 Our Site may provide links to independently owned, controlled and/or managed websites that may have their own information collection practices and privacy policies. In many cases, these links represent cooperative projects or mutual links established with the organizations connected with these sites. We do not control the content of the sites accessed by you via these links. These other sites may send you their own cookies, collect data or solicit personal information. While we identify sponsor and advertiser areas of our Site, we do not control these cookies or the content of these third parties websites. To the extent that you provide personally identifiable information to websites that link to or from our Site, different rules may apply to the use and disclosure of your personally identifiable information. To the extent that the Site includes third-party advertisements, the privacy policy of the advertiser providing the advertisement will govern the use of your personally identifiable information collected during your access to the advertisement. AGI does not control linking practices of other parties’ websites and does not monitor or claim responsibility for any content or privacy practices of such websites. Once you have left our Site, you must read the privacy policy of the other party’s website to see how your personally identifiable information will be handled.

2. Other Types of Information That May Be Collected

2.1 IP Addresses

An Internet protocol address, or IP address, is automatically assigned to your computer when you access the Internet, and is used by web servers to identify your computer. When you access our Site or the Software, we may log your IP address; however, your identity will remain anonymous to us unless you provide it to AGI for registration purposes. We log the IP addresses for system administration and for auditing the use of our Site or the Software. We may also use IP addresses to collect statistical information for marketing and other purposes.

2.2 Cookies or Tracers

From time to time, we may place information on your computer to allow us to identify you. This information is known as a “cookie.” We will only use cookies to view information on User’s computer’s hard drive that was placed there by a cookie from our Site, such as your preferences or which pages you have visited on the Site. However, a cookie will not allow our Site to learn any personally identifiable information that you have not otherwise disclosed (except as described below). AGI does not use cookies to store information such as credit card numbers, telephone numbers or other information you provide. By understanding how and when our visitors use the Site, we can continually improve our Site, as well as our products and services. If you wish to disable cookies, your browser can be reset to refuse all cookies or indicate when a cookie is being sent. In some instances, we use tracking scripts or "tracers" that recognize a unique identifier from a cookie placed on your hard drive by another website. These are used by AGI solely to gauge the success of our own advertising. For instance, we may use a tracer to determine whether you visit our employment pages after visiting a resume or career site where AGI placed a banner ad. We do not use tracers to gather information on your use of the Internet unrelated to AGI. Please note that AGI does not use tracers to determine your personally identifiable information.

2.3 Web Beacons

Web beacons are small files that we may place on our Site, which count the number of unique users that have visited a specific page on the Site and the number of times a given page has been displayed. This information is collected only in the aggregate and is generally not linked to any personally identifiable information (except as described below).

2.4 STK User experience information

This information includes data indicating the frequency at which portions of the software suite are exercised as well as insights into any failures that may be encountered during normal operations. This data is primarily analyzed in the aggregate for the purpose of identifying trends and is generally not linked to any personally identifiable information.

3. Use of Information

3.1 Use and Sharing of Information

AGI may use and disclose your personally identifiable information only as set forth herein. Anonymous data collected using cookies and web beacons may be analyzed in the aggregate to determine collective user characteristics, to understand user traffic patterns, sales information and user behavior on the Site or the Software. Such information also may be shared in the aggregate with third parties for advertising purposes, to enhance our Site or the Software, to enhance our products and services and to analyze how and where to best use our resources. When you contact AGI, we may keep a record of your communication to help solve any issues. We may use your email address to inform you about our services, such as letting you know about upcoming product upgrades or version releases, unless you notify AGI that you do not want to receive these materials through our opt-out process, which is explained in all correspondence from AGI.

3.2 Monitoring and Compliance

Although AGI is under no obligation to monitor the Site or the Software, we may monitor, store, review and disclose to third parties any information, including your personally identifiable information, obtained on or through the Site or the Software as may be needed or requested to satisfy any applicable governmental law, regulation, investigation or proceeding. Additionally, we may use IP addresses to assist in identifying a particular user if we believe it is needed to enforce compliance with these terms or to protect our company, employees, Site, the Software, or customers.

4. Security of Personally Identifiable Information

4.1 AGI utilizes several methods to protect you from unauthorized access, alteration, disclosure or destruction of information we hold. In particular:

  • We encrypt many of our services using SSL.
  • We review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems.
  • We restrict access to personal information to AGI employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual or terminated if they fail to meet these obligations.
  • We actively monitor network traffic.

4.2 While AGI tries to prevent third-party access to personally identifiable information, you should keep in mind that data transmission over the Internet is not 100% secure and any information disclosed online can potentially be collected and used by someone other than the intended recipient. In view of the foregoing, AGI cannot warrant that your personally identifiable information will not be disclosed to or accessed by parties other than those authorized under this Privacy Policy.

5. Updates to Your Information

5.1 At your request, AGI will permit you to access information about yourself in our database by contacting webmaster@agi.com. If you believe any of the information is incorrect or needs updating, please advise us. AGI will correct our records upon verification of the requested change. In order to enforce the terms of this Privacy Policy, resolve disputes or provide information to satisfy applicable governmental laws, regulations, investigations or proceedings, we may need to retain your personally identifiable information in our files. Additionally, your personally identifiable information may be retained in residual back-up files that are a function of our network’s back-up systems.

6. Changes

6.1 Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice.
